Workers Compensation Insurance Specialist

However, it is incumbent on you to properly track all the work your people perform and obtain certificates of insurance from your subcontractors, or they will be treated as employees, and you will have to pay workers comp on their labor. If that is the case, make sure each subcontractor is classified correctly.

This should be a partial checklist of the things you ask your existing or new agent you are considering:

  1. Can I provide you with a list of all the types of work we perform and will you provide me the code and rate for each?
    This is what Mecherath needs for you to properly track all of your workers comp cost, by each code.
  2. Will you explain when and how each code is applicable so I don’t make a costly mistake
    The Carpentry code 5645 is commonly used for all work, but may not apply if you are not doing structural work, this could drastically change your cost.
  3. Are there any policy exclusions or restrictions? (Lead Paint/Asbestos, limits, number of claims, best to ask related to your specific work)
  4. Would a written safety and drug program reduce my insurance cost?

  5. What are the requirements if I work in more than one state (many of us boarder other states, best to check and make sure).
    Does this include auto coverage?
  6. What are the payment options. Recently pay as you go has become popular.
  7. Claims; what is the process, how can I lower my cost?
    A great resource for this question is here: https://www.workcompprofessionals.com/employers/  In some states, you may be able to control what doctor your employee goes to in case of an injury, is this doctor your advocate, can the employee come back to work at a lessor role during the rehab process?   8. What specifically do I need for my audit and how can I have more control over the outcome?
  9. What training does your company offer? (changes in laws/webinars/podcast/documentation/blogs/etc.)
  10. How does my “Experience Mode Factor” affect my rate and how do we do an audit?
  11. What discounts or savings are available, and how do we go about reviewing my policy/when?

Specifically, If You Have Subcontractors

You will pay the workers compensation for your subcontractors UNLESS you have a Certificate of Insurance (COI) from their insurance company which will clearly show they have workers compensation insurance and General Liability insurance (GL).
We suggest, their COI should (for each project) name you and your client as “Additionally Insured”.

Additionally Insured is a type of status associated with general liability insurance policies that provides coverage to individuals or groups not initially named in the policy. With an additional insured endorsement, the additional insured will then be protected under the named insurer’s policy and can file a claim if they are sued.
